The Jury
Well, it seems many today, and firearm sales would seem to confirm this, are planning on violently taking back their government. But it doesn't have to be this way. The founders who were incredibly enlightened designed an enlightened system of government spelled out in the U.S. Constitution. Shame on any American who has ever disparaged even one word of this brilliant document.
Before getting violent, there is an ace in the hole that any law abiding voter can do. It is called jury nullification. The concept dates from the signing of the Magna Carta. Basically, it calls for the king's law to be judged as just or not by the jury before condemning anyone as guilty for that crime. This became an issue when colonialist John Peter Zenger began publishing a newspaper in New York to challenge the onerous policies of newly appointed colonial governor William Cosby. Well it was against the law to say anything bad about the king's representative even if it were true. So Zenger was charged but the jury ignored the demand for a conviction and ruled not guilty. Soon the colonialists were being hauled to England to be tried setting in motion another reason to become independent from England.
Maryland where I live is one of two states that put the juror's rights and responsibility to rule on the law itself right in the state constitution - but you will rarely find a judge in Maryland who will permit one word of Article 23 to be uttered in their courtroom. It states: "In the trial of all criminal cases, the jury shall be judges of law as well as of fact..." Pretty clear aye? But beginning with the Sparf & Hansen v. U S, 156 U.S. 51 (1895) the Supreme Court ruled that, even though jurors could still rule on the law, their right to hear that instruction in the courtroom could be blocked by the trial judge supposedly to protect defendants. Up until that time it was normal for lawyers to remind the jurors to weigh the law itself and how it was being employed by the government. The minority of the Supreme Court in this decision warned that soon Courts would be claiming that jurors could not rule on the law. They were absolutely correct and today even in Maryland where it is spelled out in plain English the judges regularly lie, violate their oath of office and say jurors can only rule on the facts. POPPYCOCK!
You as a juror most certainly can rule on the law and even the black robed tyrants admit jurors have the power to rule on the law and how it's being applied in the case. They just cry that jurors don't have the right anymore and that we are somehow as citizens abusing power by overruling the law in a criminal case. Does that make sense to you amigos? Is our system of government so perfect that it no longer must stand before the people to be judged?
The reality is this amigos. Our national government is a corrupt disgrace and will have to be dismantled and completely rebuilt following the tenets of the U.S. Constitution. Anyone who wants to begin acting like real Americans again with core principles based on individual liberty and the idea that individuals own their time, body and labor output can begin immediately defending these principles. It only takes one juror to block a conviction. Here is the principle. As long as an individual is not acting violently, fraudulently, coercively and has engaged in only consensual activities in private - that accused person must go free. Tax evasion is a crime alright but by the state for stealing. Any victimless crime should be met with a not guilty ruling. It is madness to house illegal vegetable users in this economy. Also, while I agree that drug and alcohol use should be illegal in many public venues, life in prison or other cruel and unusual punishments should mean a not guilty verdict. This is vital feedback to change the law to one that is more reasonable. It's time to stop this federal nonsense and meddling in the affairs of the states and individuals.
